The Constitutional Court set aside the judgement of the Supreme Court, to the effect that it was contrary to accepted principles of morality, if the employer has claimed the agreed contractual fine of CZK 420 000 for breach of non-competition clause from the employee. The employee has thus been employed by the competitor for four days only.
Nevertheless, the Constitutional Court stood up for the employer that the duration of the new employment shall not be decisive, and therefore it set aside the judgement of the Supreme Court.
